For the headers depends on if you use them. For the modules not as long as the kernel can still find them.
Yeah, I think it broke my alx patch for Wake-On-LAN functionality (could also be the different kernel version though) but I can confirm that the remote works with linux 5.10 and the reverted bad commit.

I already sent a mail to them pointing to the kernel bug I opened (https://bugzilla.kernel.org/show_bug.cgi?id=204317) and where I added my findings. Not sure Patrick is active anymore since my mail was returned due to a full mailbox. Sean however has reacted so I got some hope that this can finally be fixed. Thank you very much for all of your support here so far!
