I did not know that software patents apply to Europe as well.
It's not really a software patent if you think a bit about it ;-) It's definetely more related to typography, the lcd displays and alike.
Not sure if I get this right, but it says that it's in a "Pending" state which means it's not yet "Granted", which means we can still use it legally for a while, or maybe even for a longer if it gets "Not valid" state eventually :D
So what it means is that currently it's probably legal to use these patches for at least those who live in EU.
Still, we don't know if the patches use exactly the same technique as described in this Adobe's patent grant request you linked here.
(And BTW basically you are right, luckily the software patentes are not being granted in EU _yet_. But that's pretty OT anyway.)

I want to see the person who sues you for using subpixel rendering under Linux. Seems ridiculous to me - I am not even using the Adobe algorithm I assume.

I've just noticed this explanation uploaded by David to his site/repo (dunno how to call it).
In the end part we can see some interesting note:
I have even provided patches to do just that a loooong time ago; for some reason, these have never been integrated by the respective library maintainers. I hope some day they'll wake up (though my hope is pretty dim). I suspect that Linux distribution packagers are already applying these patches though...
IMO, that could be argument for merging David's patches with Arch packages. We don't bother about patents too much, do we?

As an alternative for a slightly different look, there's now Arch packages for the Gentoo Xeffects versions of libxft and cairo

Wow! Just discovered this thread and installed the -lcd versions from community. The difference is astonishing. Thanks so much! (Haven't yet tried the new Gentoo versions in AUR).
Edit: Just installed the -xeffects versions from AUR, and they work well. Seems to be a little less "fake color" blur behind the text than with -lcd (not that there's much with -lcd). YMMV, I'm sure.

so, will these make my fonts look exactly like they do on ubuntu? because when I was using ubuntu (up until about 2 weeks ago - newly switched to arch) they looked perfect. I've tried the previous -lcd packages but they gave me a headache. do the ubuntu ones actually do what ubuntu does? if so, that's wonderful.
and what exactly should I remove before installing these? cairo libxft freetype2, right?

pacman should tell you what to remove..
...these are AUR packages
LOL, install yaourt from AUR and then install the packages. It will tell u exactly what u need to remove. Sometimes people forget when making aliases to certain programs. Don't concern yourself with that, just install yaourt.
yaourt -S libxft-xeffects
