How come Ubuntu can integrate native ZFS support but not Arch?

I understand there is a licensing issue, but why can Ubuntu do it? Currently I am locked out of all my drives because the ZFS-linux-git package is broken or not up to date with latest Arch update. Not being able to access important drives after an Arch update means I can't do any work until it's sorted, which can take days.

Probably because Canonical have plenty of lawyers ready for if Sun/Oracle do decide to take them to court. Arch doesn't.
Also Arch is rolling-release so tries to release new kernels ASAP. Having to wait until ZFS was compatible would hold up this process.

Is it possible for me to know if ZFS package is compatible before I run an Arch update?

Use the versioned, non-git package, then ignore the kernel package until there's a matching update for the zfs module package.
