Cannot control brightness if KMS is activated (intel driver)

Since i updated my kernel to 2.6.32 i cannot control my laptop brightnews, today i updated to 2.6.33 and i have the same issue, my hardware is:

I have another problem, since this update my Laptop doesn't detect if its charging or using the battery (the battery still charges, but kde acts like nothing happened when unpluggin the ac power) and i have ac and battery kernel modules loaded.
