Fresh install, 3x2TB seagate disc, one disc failed or ?

Hi all,

I have a problem with fresh installation. I have UEFI board, booted into UEFI using modified USB stick with refind (found this solution on forum because original is not working), and created RAID setup over 3x2TB  disks. Disks are brand new Seagate SV35

I have tried all hardware things such as: change data cable, change port, change power cable.
I have tried in bios setting IDE or AHCI.
All problems are on one disk, regardless the above changes.
I have no spare disk to replace the one which is suspect to fail.

during RAID1 creating I got following error:

I have found that many of the people out there had a similar issue but with WD disks, which was solved by disabling ncq, so I have tried and added this to [USB stick]/EFI/boot/refind.conf:

options "archisolabel=ARCH_201211 libata.force=noncq"

in a hope it will be passed to kernel as option to disable ncq, which looks successful according to dmesg:

ata1.00: FORCE: horkage modified (noncq) 

But with no luck, while creating RAID I got pretty same error.

Smartctl short test returned no error as expected, long test is now in progress.

well, now I'm out of ideas, and I thing the disk is new but broken.

Do you guys think that I have to sent the disc back? It is another waiting for replacement, and on top of that smart is not displaying any errors, so it can be another problem in shop ...
