Whether he can distribute the modifications, I dont know, the author specifies no license. But it certainly aint closed.
The only way to write a closed gtk theme would be to write a whole engine, and the stuff by lokheed is definitely not that, it's just a regular pixmap theme.
The metacity theme in that screenshot by lokheed, is in the zip for the GTK2 theme in the zip you download off deviantart.

Yes the theme isn't closed because of his pixmap nature, but it isn't free to be modified and redistribuited, like other GNU/linux themes.
I personally dislike this approach to "art", even though i personally agree with lokheed because the people used to steal artworks and make a collage of theme. i repeat i'm an artist like lokheed, i have released "Candido", "Candido-Graphite" in GPL, but probably I'll be sad if someone steal all my artworks to do modifications without giving credit to whom (me) done the big work and have lost days on it.

Surely it's not possible that this guy has any reight to exercise a proprietary license over the name tempura. Instead of spending his time quibbling over the use a noun on art.gnome.org he'd be better off investing his time in seeking legal recourse against yo!sushi

lokheed, probably did that because alot of people in gnome-look were using his stuff and not giving him credit, even spelling his name wrong!
Im sure he wont mind modifying, but what he doesnt want you to use the same thing and not give him credit.
But who knows, just a thought.

I don't like the approach to, but there's no reason to enforce your dislike on others. I understand exactly why he doesnt want people reproducing or using his work. But you can still manipulate it so long as you dont distrobute it.
To the contrary, I wouldnt be surprised that he would allow you to use some of it if you actually asked for permission unlike the rip that was posted on art.gnome.org.

I'm the creator of the Cobble Openbox theme, I've made a theme to match Tempura that I'm going to release soon. It's based on the Cobble theme with some things changed and it requires a patched version of Openbox 3.3-rc2 since it uses to a split gradient.

I'm not sure actually. I hope this gets added to the final 3.3 version. There have been some nice patches written for 3.3. One of my favourites is a patch that makes it so you can hide the menu title. There's also another patch (which is already in 3.3-rc2) that makes it so you can hide disabled buttons. My only complaints with these patches is hiding these elements is done in your rc.xml file. I'd like to see these done in themerc files so you can enable or disable these things on a per theme basis.
