With new kernels (kerenl26 and kernel26ck) i'm not able to load toshiba_acpi module due to a patch added from kernel 2.6.20...
When i try to load the module i get this error message:
modprobe toshiba_acpi
FATAL: Error inserting toshiba_acpi (/lib/modules/2.6.20-ck/kernel/drivers/acpi/toshiba_acpi.ko): Device or resource busy
In dmesg i have:
toshiba_acpi: Toshiba Laptop ACPI Extras version 0.19a-dev
toshiba_acpi: HCI method: \_SB_.VALD.GHCI
toshiba_acpi: failed to register misc device 181 ("toshiba")
It is a well known bug, as you can see here:

Now the question is: why the patch is still added in new kernels when, on Saturday 14 April 2007, the bug was closed with the following reasons:
Reason for closing: Won't implement
Additional comments about closing: until patches are sent that work

Can you confirm your current kernel version? modprobe will only attempt to load a module from /lib/modules/2.6.20-ck if you are running the 2.6.20-ck kernel, yet you refer to "new kernels" - right now, the current versions of kernel26 and kernel26ck are 2.6.21.5-1 and 2.6.21.ck2-1 respectively.
The patch in question is not restricted to any particular kernel version, so it can be applied to both 2.6.20 and 2.6.21 kernels, as has happened here. tpowa would be able to give you more details on the bug report you mention - if he doesn't reply here, you could request that it be reopened.

My current kernel version is kerne26ck 2.6.21.ck2-1 rebuilded without toshiba_acpi patch and everything works... (that's why i had to paste an error message regarding to an older kernel version i've saved in a text file)

I've just upgraded to kernel26ck 2.6.22.5.ck1-1 and the toshiba_acpi patch is still there....
