ath5k - now defaults to "off" on boot ?

Relatively recently wireless "stopped working" on the laptop (within the last week or so).

I Just figured out that the wireless starts working when I now physically press the wirless "button" on the laptop.
However the button can't be used to turn the wireless off.

There's no bios option to set up the wireless power on start.

this is a compaq using an ath5k driver.
