file manager launches in background & minimized on openbox

hi, I have this problem when launching rox-filer with Winkey+E binding in .config/openbox/rc.xml, the file manager opens not on top like it would be normal but minimized to the taskbar and also strangely enough in the background when I have recently opened an xterm .
what could possibly cause this behaviour?
I start x from inittab with exec ck-launch-session dbus-launch openbox-session in my .xinitrc
and I have like I said this binding in my .config/openbox/rc.xml

    <keybind key="W-e">
      <action name="Execute">
          <name>rox</name>
        <command>rox</command>
      </action>
    </keybind>
