my wireles configuration can be found on another post

everything was working fine until some weeks ago, everytime i try to connect to the wireless network, it does not work.
chipset is BCM4303 (say lspci and hwd, though in the past one was saying BCM4301 and the other BCM4303), and I use the b43legacy module. the problem is that now, whenever I try to scan for an AP (either with iwlist or wpa_supplicant), I get the answer that the network is down.
The first command I use are:
iwconfig wlan0 essid eduroam
ifconfig wlan0 up
then, when I try wpa_supplicant or iwlist scan wlan0, I got the mssage that the network is down.
If I try to bring it up again (ifconfig wlan0 up), i got the message:
SIOCSIFFLAGS: Unknown error 132.
I tried to reinstall the firmware but it was pointless.
any help?

ok, now i figured out, with the help of rfkill, that the issue is there is a hard block on the wireless lan, but that only happens when i try
ifconfig wlan0 up
without bringing wlan0 up with ifconfig, i'm unable to scan for APs nor to connect to any

the thing is, when i bring wlan0 up with ifconfig, the hardblock on the wireless lan is brought from no to yes, and then if i try to look for an AP (iwlist wlan0 scan), i got the message that the interface does not support scanning.

any idea how i can prevent ifconfig to hard block the wlan0 interface? (there is no button on the laptop)
