i have a new install had to downgrade kernel to fix wifi (figured this would be easiest) since it was a new install i still had to install i.e X and graphics drivers, wasn't paying attention when i installed nvidia it upgrade back to kernel 3.3, so what im asking is which nvidia driver doesn't require 3.3 and I'll just downgrade that

No nvidia driver strictly requires 3.3, they all work with whatever kernel you want. Just create your own nvidia package for the specific kernel you want to use.
Also worthy of mention is that all driver versions except 295.40 have a security vulnerability.

i think now its best just to use linux-lts and nvidia-lts is there any con's

now your thinking corbomite sounds like a good idea, you could also check the debian forums they all secretly use arch on the weekends

I did read that but decided lts was a better route for me, and im sure i will get patched in a later release, and ive got no problems with lts since its got nvidia backport
